1. Purpose of This Policy

This DPDPA Privacy Policy is published in compliance with the Digital Personal Data Protection Act, 2023 (India). It explains how Jesastic.in collects, processes, stores, transfers, and protects all forms of personal data, sensitive data, and digital media shared by users, clients, partners, and vendors.

Jesastic.in primarily serves Indian users and businesses, while international clients are served through Jesastic’s global infrastructure.

2. Scope of Data Covered

This policy applies to ALL forms of data, treated as "Digital Personal Data" under the DPDPA, including:

  • IP Address & Device Info
  • Payment References
  • Uploaded Photos & Videos

3. Legal Basis for Data Collection

Your data is collected only when you submit a form, message on WhatsApp, place an order, send media, or make a payment. Your action itself is treated as your legal consent.

4. Purpose of Data Processing

Your data is used strictly for:

  • Service delivery & Technical setup
  • Design, development & Backend execution
  • WhatsApp & call communication
  • Payment verification & Order fulfillment
  • Legal compliance & Security

We DO NOT sell or trade your data.

5. Media & Content Protection Clause

All photos, videos, voice notes, music, QR media, and personal content shared with Jesastic:

  • Used only for your service
  • Stored securely with limited internal access
  • Never sold
  • Never shared publicly
  • Never reused without written permission

⚠️ However, once content is transmitted online, 100% absolute security is not technically guaranteed by any entity worldwide.

6. Cyber Attack & Force Majeure (Liability Limitation)

Despite all security systems, Jesastic shall NOT be held fully responsible for data leakage or loss caused by:

  • Cyber attacks, Hacking, Malware or Ransomware
  • Server exploits or Cloud service breaches
  • Infrastructure, Internet or Power failures
  • Natural disasters, War, Riots or Pandemics
  • Zero-day vulnerabilities or Global cyber warfare

In such cases, Jesastic’s liability is legally LIMITED to the maximum extent permitted by Indian law.

7. Data Sharing with Third Parties

Data may be shared only with essential service partners strictly for fulfilling services (Server hosting, Transaction processing, Logistics/Printing, etc.). All third parties are bound by confidentiality obligations. Jesastic never sells user data.

8. Data Retention & Deletion

Data is retained only as long as required for Service delivery, Legal compliance, and Accounting. After this period, data is securely deleted or permanently anonymized.

9. User Rights Under DPDPA

You have the right to Access, Correct, or Request Deletion of your data, or Withdraw consent. All requests must be submitted in written form.

10. Global & Child Data

For international clients, data may be processed outside India using secure infrastructure. We do not knowingly collect data of children under 18 years.

15. Ultimate Liability Limitation

Even after taking all security measures, Jesastic’s responsibility in any data-related incident is:

  • Commercially reasonable
  • Restricted by Indian legal limits
  • Not unlimited
  • Does NOT include indirect loss or reputation damage
  • Does NOT include business or revenue loss
